1. Agreement
These Terms govern your use of victimcheck.com and related services (the "Service"), operated by VictimCheck GmbH, Mainzer Landstraße 150, 60327 Frankfurt am Main, Germany. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
2. Who may use the Service
You must be at least 18, or have the consent of a parent or guardian, and must use the Service only for lawful purposes.
3. What the Service does
VictimCheck lets you check whether identifiers you provide — an email address, phone number, or wallet address — appear in the scam and fraud records available to us. Many people are unsure whether what happened to them was a scam at all, and the Service exists to help them find out what has already been reported.
4. What the Service does not do
To be explicit, we do not and cannot:
- Recover money, cryptocurrency, or other assets. We will never contact you offering to recover funds, and will never ask you to pay a fee, deposit, tax, or "release charge" to get money back. Anyone claiming to be us and asking for such a payment is impersonating us — report it to us and to the police.
- Provide legal, financial, tax, or investment advice.
- Act as, or on behalf of, any police force, regulator, court, or government agency.
- Guarantee that our records are complete or accurate.
- Make any finding that a named person or company committed a crime.
5. Fees
The Service is free to use.
Right of withdrawal (EU consumers): you normally have 14 days to withdraw from a purchased digital service. Where you ask us to begin immediately and acknowledge losing that right on full performance, it ends once the service has been fully performed.
6. Accuracy of results
Results come from the sources described in our Privacy Policy. A result showing no match does not mean you were not scammed — only that nothing matching your search appears in the records available to us. A match does not by itself prove a criminal offence occurred, or that any particular person was responsible. Treat any result as one piece of information among others, not a substitute for advice from the police, your bank, a consumer advice body, or a lawyer.
7. Your responsibilities
You agree not to: search for other people's identifiers in order to investigate, profile, harass, stalk or expose them; submit false, misleading or malicious reports; use the Service to accuse, defame or threaten anyone; scrape, bulk-download, reverse-engineer or resell the records; circumvent rate limits or security measures; or upload malware or infringing content. We may suspend or terminate access for breach.
8. Content you submit
You keep ownership of what you submit, and grant us a non-exclusive, worldwide, royalty-free licence to store, process and use it to operate the Service, including — where you have consented — adding it to our records so others can check against it. You confirm you have the right to submit it and that it is accurate to the best of your knowledge. We may remove content at our discretion, particularly where it names a third party without adequate basis.
9. Reports about third parties
If a report identifies a third party, that person has data protection rights including access and objection. We may notify them, correct or remove entries, or decline to publish, as the law requires. Do not submit a report unless you believe in good faith that it is true.
10. Intellectual property
The Service, its design, text and software are owned by us or our licensors. You may not copy or reuse them beyond what these Terms allow.
11. Third-party links
The Service may link to external sites, including those of authorities and consumer organisations. We do not control them and are not responsible for their content.
12. Availability
We aim to keep the Service available but do not guarantee uninterrupted access, and may modify, suspend or discontinue features at any time.
13. Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, and so far as the law permits: we are liable without limitation for intent and gross negligence; for slight negligence only for breach of an obligation essential to the purpose of the contract, and then only for foreseeable, typical damage. We are not liable for indirect or consequential loss, loss of profit, or decisions you take on the basis of a search result.
14. Indemnity
You agree to indemnify us against claims arising from your misuse of the Service or from content you submit in breach of these Terms.
15. Governing law and disputes
Governed by German law, excluding conflict-of-law rules. Consumers keep the protection of the mandatory laws of their country of residence and may bring proceedings in their local courts. The European Commission provides an ODR platform at https://ec.europa.eu/consumers/odr. We do not participate in consumer arbitration proceedings before a consumer arbitration board.
16. Changes
We may update these Terms, posting the revised version here with a new date and, for material changes, reasonable notice.
17. Severability
If a provision is found invalid, the rest remains in force.
